CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1623 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> A.F. EVANS COMPANY FOR REZONING TO THE PUD <br /> (PLANNEF} UNIT DEVELOPMENT) - RDR (HIGH DENSITY <br /> RESIDENTIAL) DISTRICT AND DEVELOPMENT PLAN <br /> APPROVAL TO ALLOW A 146-UNIT APARTMENT <br /> DEVELOPMENT TO BE SITUATED ON APPROXIMATELY <br /> 7.4 ACRES LOCATED AT 5300 CASE AVENUE (PUD-94-01 <br /> <br />WHEREAS, A. F. Evans Company applied for rezoning to the PUD (Planned Unit <br /> Development ) - HDR (High Density Residential) District and development plan <br /> approval to allow a 146-unit apartment development, with units available for <br /> market-rate, low- and very-low income households on a vacant 7.4 acre site <br /> located at 5300 Case Avenue; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by <br /> Council on May 3, 1994; and <br /> <br />WHEREAS, Council received the Planning Commission's recommendation for approval of the <br /> development plan and rezoning; and <br /> <br />WHEREAS, a duly noticed public hearing was held on May 3, 1994; and <br /> <br />WHEREAS, the City Council finds that this development plan and rezoning is consistent with <br /> the General Plan policies of the City of Pleasanton; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br /> Section 1: Approves the rezoning of an approximately 7.4 acre site located at 5300 Case <br /> Avenue to the PUD (Planned Unit Development) - HDR (High Density <br /> Residential) District. <br /> <br />Section 2: The Zoning Map of the City of Pleasanton dated April 18, 1960, on file with the <br /> City Clerk, designating and dividing the City into zoning districts is hereby <br /> amended by Zoning Unit Map//423, attached hereto as Exhibit "A", dated <br /> May 3, 1994, and incorporated herein by reference. <br /> <br /> <br />
