CITY COUNCIL OF THE C1TY OF PLEASANTON <br /> <br /> ALA1VIEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1617 <br /> <br /> AN ORDINANCE OF THE CITY OF PLEASANTON <br /> AMENDING TITLE 10 O F THE PLEASANTON MUNICIPAL <br /> CODE BY ADDING A NEW CHAPTER 10.02 TO PROHIBIT <br /> TARGETED PICKETING OF RESIDENCES AND <br /> DECLARING THE URGENCY THEREOF <br /> <br />WHEREAS, it is in the public interest and it is critically important to the public health, safety <br /> and welfare of all Pleasanton residents that the right to privacy in one's home, <br /> and the right to enjoy tranquility, well being, and a sense of security in one's <br /> house and in one's neighborhood be preserved and protected; and <br /> <br />WHEREAS, picketing activity in a residential neighborhood which is targeted at a particular <br /> residence or household whose occupants do not welcome such activity may harass <br /> and intimidate such occupants, may harass and intimidate other residents in the <br /> neighborhood, is inherently and unreasonably offensive to and intrusive upon the <br /> right to privacy in the home and may cause the occupants of such home and their <br /> neighbors to experience great emotional distress; and <br /> <br />WHEREAS, such unwelcome and targeted picketing activity creates a "captive audience" <br /> situation because the occupants of a residence or household, and their neighbors, <br /> cannot readily move to another residence, household or neighborhood in order to <br /> avoid the unwelcome picketing activity; and <br /> <br />WHEREAS, on several occasions in the last few months, most recently on Thanksgiving Day, <br /> unwelcome and targeted picketing activity resulted in the disruption of a <br /> neighborhood, caused persons residing in that residential neighborhood to <br /> experience great emotional distress, and resulted in children not being able to play <br /> outdoors without being subjected to graphic and unpleasant posters and without <br /> being intimidated; and <br /> <br /> WHEREAS, this "captive audience" situation and the protection of the right to privacy in the <br /> home requires the enactment of a reasonable time, place and manner restriction <br /> upon such unwelcome picketing activity that is targeted at a particular residence <br /> or household; and <br /> <br /> <br />
