CITY COUNCIL OF THE CITY OF pLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1608 <br /> <br /> AN ORDINANCE AMENDING SECTION I (PART) OF <br /> ORDINANCE NO. 1588 AND CHAPTER 6.60 OF THE <br /> PLEASANTON MUNICIPAL CODE CONCERNING MOBILE <br /> HOME SPACE RENTS <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br />Section ~: Section 1 (part) of Ordinance No. 1588 and Section <br /> 6.60,020 of the Pleasanton Municipal Code are hereby <br /> amended to read as follows: <br /> <br /> ,,6.60.020 Definitions- <br /> <br /> (Subsections A - I, no change.) <br /> J. ,Monthly Rent' or 'Base Year Rent' - The monthly Space <br /> Rent for each mobile home space in pleasanton to which <br /> Ordinance No. 1588 applies as each existed on the effective <br /> date of that Ordinance and as set forth in Exhibit "A" to that <br /> Ordinance. <br /> <br /> (Subsections K - R, no change.)" <br /> Section 2: Section 6.60,075 is hereby added to Chapter 6.60 of the <br /> Pleasanton Municipal Code to read as follows: <br /> <br /> "6.60.075 Base Year Rent AdjustmentS. <br /> A. Purpose. It is presumed that the Base Year Rent is <br /> reasonable and reflects general market conditions- However, <br /> in the event the Park Owner believes that such Base Year Rent <br /> is not reasonable or does not reflect general market <br /> conditions, the purpose of this section is to provide a <br /> mechanism for the review and adjustment of a requested <br /> increase in the Base Year Rent. <br /> B. Presumption that Base Year Rent Was Reasonable an~ <br /> Reflected General Market Conditions. For the purpose oi <br /> determining whether the Base Year Rent should be adjusted, it <br /> shall be presumed that the Base Year Rent was reasonable and <br /> reflected general market conditions- <br /> <br /> <br />
