CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1711 <br /> <br /> AN ORDINANCE AMENDING SECTION 1'7.36,080 OF TIlE <br /> PLEASANTON MUNICIPAL CODE AND ADDING SECTIONS <br /> 17.36,082 AND 17.36,085 TO TIlE PLEASANTON MUNICIPAL CODE <br /> CONCERNING LOW INCOME IIOUSING PROJECTS <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Section 17.36.080 of the Pleasanton Municipal Code is hereby amended to read as <br /> follows: <br /> <br /> "17.36.080 Low income rental project. <br /> <br /> A. A low income rental project shall be a residential project having a minimum of <br /> twenty-five percent (25%) of the total units reserved for rental by low income <br /> households, defined as households whose income, adjusted for household size, <br /> does not exceed eighty percent (80%) of the median income level for the <br /> primary metropolitan statistical area which includes the County as determined <br /> by the U.S. Department of Housing and Urban Development. <br /> <br /> B. The rents charged for the units to be occupied by low income households shall <br /> not exceed thirty percent (30%) of the monthly income of a low income <br /> household. <br /> <br /> C. Units designated for low income households must be reserved for such <br /> households for at least twenty-five (25) years. <br /> <br /> D. Units designated for low income households shall be of the same size and <br /> quality as other units in the project. <br /> <br /> E. A project owner/developer shall enter into an agreement which reflects the <br /> terms of this section. The agreement shall be recorded and shall run with the <br /> land. The agreement shall also provide that an annual compliance statement be <br /> submitted to the City for its review. <br /> <br /> F. The selection of prospective renters for the low income units within a low <br /> income rental project shall be subject to the City's preference and priority <br /> system." <br /> <br /> <br />
