PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-18 <br /> <br />RESOLUTION APPROVING THE REQUEST TO MODIFY THE DESIGN AND <br />LOCATION OF THE LOWER PATIO FENCE OF THE PREVIOUSLY-APPROVED <br />COFFEE ROAST EXPRESS BUILDING UNDER CONSTRUCTION AT 780 MAIN <br />STREET, AS FILED UNDER CASE Z-99-25 <br /> <br />WHEREAS, <br /> <br />Diane and Edward Churka have applied for design review approval to modify the <br />previously-approved Coffee Roast Express building under construction at 780 <br />Main Street by modifying the design and location of the lower patio fence along <br />Main Street; and <br /> <br />WHEREAS, zoning for the property is C-C (Central Commercial), Downtown Revitalization, <br /> Core Area Overlay District; and <br /> <br />WHEREAS, <br /> <br />at its duly noticed public hearing of February 24, 1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff conceming this application; and <br /> <br />WHEREAS, <br /> <br />projects of this nature are categorically exempt from the requirements of the <br />Caiifomia Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, <br /> <br />the Planning Commission determined that the relocation of the lower patio fence <br />would be appropriate, as long as there are no modifications to the design of the <br />planter area with brick borders. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves the request of Diane and Edward Churka to relocate the lower patio <br />fence of the previously-approved Coffee Roast Express building under <br />construction at 780 Main Street, subject to the conditions (which require that no <br />changes be made to the design of the planter area with brick borders), as shown in <br />Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br /> <br />
