~" {Jr FL:_'?~cANTON <br />. .. ,,i~ r OF ALAMEDA <br />:~ [.~,E OF CALIFORNIA <br /> <br />~£EIOI..UTIO N NO.66'1~ <br /> <br />A RESOLUTION CONCURRING IN THE ESTABLISflMENT OF A <br />SPECIAL DRAINAGE AREA FOR THE CITY OF PLEASANTON <br /> <br /> WItEREAS, the Board of Supervisors of the Alameda County Floood <br />Control and Water Conservation District have indicated an in- <br />tention to establish a Special Drainage Area pursuant to Section <br />12.2 of Act No. 205 of the Uncodified Acts of the Water:Code of <br />the State of California; and <br /> <br /> WHEREAS, a portion of such area will lie within the tncorporr- <br />ated area of the City of Pleasanton; and <br /> <br /> WHEREAS, such Act requires that before the Board of Super- <br />visors of the District can acquire authority to proceed with the <br />establishment of any special drainage area, the exterior boundari~e~ <br />of which will include any land lying within the exterior boundaryy <br />any cha~tered or.incorporated city within the District, the Boardd <br />shall first obtain the concurrence of such city by a resolution Obr <br />ordinance adopted by a majority of the members of the City Counciil <br />of such city; and <br /> <br /> WHEREAS, the establishment of Special Drainage Area No. 7-1 <br />is considered essential to the solution of storm drainage problemms <br />of the portion of the City of Pleasanton lying within said Spec£aal <br />Drainage Area No. 7-1; <br /> <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br /> 1. The City Council of the City of Pleasanton does hereby <br />evidence the concurrence of the City for the Board of Supervisorss <br />of the Alameda County Flood Control and Water Conservation Dist- <br />rict to establish Special Drainage Area No. 7-1 within the city <br />limits of the City of Pleasanton with boundaries as shown on the <br />drawing of said District. <br /> <br /> 2. The Alameda County Flood Control and Water Conservation <br />District is authorized and permitted to collect fees established <br />in the manner provided in said Act as a condition precedent to <br />the development of property within such special drainage area. <br /> <br /> 3. No building permit or use permit shall be issued to any <br />developer until such fees are paid by him to the Alameda County <br />Flood Control and Water Conservation District, provided such feess <br />do not exceed the pro rata share of the amount of the total actua~l <br />or estimated costs of all such drainage facilities within the <br />special drainage area which would be assessable on such property <br />if such costs were apportioned on a uniform fee schedule. <br /> <br /> 4.
