WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHERE AS, <br /> <br />NOW, <br /> <br /> CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> RESOLUTION NO. 72-19 <br /> <br />RE: ACCEPTANCE OF STREET DEDICATION AND APPROVAL <br />OF RIGHT-OF-WAY AGREEMENT FROM KAISER INDUSTRIES <br />CORPORATION AND KAISER INDUSTRIES CORPORATION, <br />SAND AND GRAVEL DIVISION, RESPECTIVELY. <br /> <br />City is in receipt of a dedication for right-of-way <br />purposes and their agreement with respect thereto <br />for right-of-way extending the commonly referred to <br />Kaiser Road across the railroad tracks in consistent <br />with potential industrial development in said area; <br />and, <br />said agreement and dedication provide for maintenance <br />of said road by Kaiser until use thereof by trucks <br />has ceased and that Kaiser will hold the City harmless <br />regarding any crossing protection necessary to effect <br />a crossing of the Southern Pacific Railroad tracks; <br />and, <br />both said dedication and agreement appear to be in <br />order and in the public interest. <br /> <br />DATED: <br /> <br />ATTEST: <br /> <br />THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br />1. that said street dedication and right-of-way agreement <br /> dated February 1, 1972, be accepted and the appropriate <br /> City Officers instructed to take steps necessary <br /> to implement said acceptance. <br /> <br />2. that acceptance and approval of said dedication and <br /> <br /> agreement not be construed in any w mitigating <br /> against exercise by City <br /> tives regarding truck traffic <br /> February 7, 1972 <br /> <br />HELEN C.
