CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 73'9 <br /> <br /> RE: INDICATING DECISION NOT TO APPEAL S.A.V.E. <br /> INITIATIVE ORDINANCE RULING <br /> <br />WHEREAS, the Superior Court of Alameda has rendered a decision <br /> <br /> invalidating the SAVE Initiative Ordinanc~ and <br /> <br />WHEREAS, the City Attorney recommends that an appeal therefrom not <br /> be taken and that in lieu thereof the staff be instructed <br /> to investigate the preparation and drafting of an ordi. <br /> nance to regulate the amount and rate of construction of <br /> <br /> residential dwelling units within the City of Pleasanton; <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br /> 1. That the City Attorney and City Manager be instructed to <br /> <br /> investigate the feasibility of an ordinance regulating <br /> the amount and rate of construction of residential units <br /> within the City, said regulation to depend upon the <br /> availability of essential municipal services and the <br /> ability of the City to absorb the municipal service <br /> burdens generated thereby. <br /> <br /> 2. That the City Council herein evidence its intention not <br /> to appeal the adverse ruling in the Alameda County Superi- <br /> or Court with respect to the SAVE Or~inance. <br /> <br /> 3.
