RE: <br /> <br /> CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> RESOLUTION NO. 78-18 <br /> <br />CANCELLATION OF PRESENT LEASE AND APPROVAL OF NEW <br />LEASE FOR CORRAL DRIVE-IN, AT 4895 FIRST STREET <br /> <br />WHEREAS, <br /> <br />property at 4895 First Street was purchased by the City <br />as right-of-way for the eventual completion of the Bernal <br />Avenue Realignment; and <br /> <br />WHEREAS, Mr. Jay Harris has a lease on the property which expires <br /> on May 31, 1983; and <br /> <br />WHEREAS, <br /> <br />Mr, Harris is selling the restaurant business he operates <br />in the building on the property and he has asked that his <br />lease be cancelled and a new lease given to the purchaser, <br />Tony Rovai; and <br /> <br />WHEREAS, <br /> <br />it is not anticipated that funds will be available for the <br />City to complete Bernal Avenue during the next five years; <br />and <br /> <br />WHEREAS, the continued lease of the property will provide additional <br /> revenue for street projects; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. Approves cancellation of the lease with Mr. Jay Harris. <br /> <br />Section 2. Approves execution of a new lease with Mr. Tony P. Rovai <br /> for a term of five years from February 13, 1978 through <br /> February 12, 1983, for a monthly rental fee of $190 for <br /> the first year of the lease with an adjustment each year <br /> in relation to the change in the cost of living (Consumer <br /> Price Index) during the previous year. <br /> <br />Section 3.
