CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 78-12 <br /> <br />A RESOLUTION APPOINTING HARVEY E. LEVINE AS CITY ATTORNEY <br />OF THE CITY OF PLEASANTON <br /> <br />WHEREAS, <br /> <br />the City Council of the City of Pleasanton was advised by <br />their present City Attorney, Kenneth C. Scheidig, that he <br />will be resigning his position effective February 17, <br />1978, in order to take the position of Assistant City <br />Attorney in the City of Concord; and <br /> <br />WHEREAS, <br /> <br />the City Council indicated its desire to fill this posi- <br />tion as soon as possible in order to insure continuity <br />in this sensitive position of the City of Pleasanton; and <br /> <br />WHEREAS, <br /> <br />Harvey E. Levine has been Deputy City Attorney of the City <br />of Pleasanton for approximately two and one-half years; <br />and <br /> <br />WHEREAS, during that time the City Council has had an opportunity <br /> to review Mr. Levine's abilities and work product; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1. Appoints Mr. Harvey E. Levine as City Attorney of the <br /> City of Pleasanton effective February 18, 1978, with a <br /> yearly salary of $25,500 and all other benefits which are <br /> presently enjoyed by the position of City Attorney. <br /> <br />Section 2. Mr. Harvey E. Levine is appointed as Acting City Attorney <br /> of the City of Pleasanton effective February 10, 1978, and <br /> shall be compensated at the City Attorney salary from <br /> February 10, 1978 until he assumes his position as full <br /> time City Attorney on February 18, 1978. <br /> <br />Section 3. Although the City Council recognizes that it cannot <br /> require as a condition of employment that Mr. Levine live <br /> in the City of Pleasanton, it encourages Mr. Levine to <br /> investigate the possibility of moving to the City of <br /> Pleasanton on or before September 1, 1978. <br /> <br />Section 4.
