CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 78-8 <br /> <br />A RESOLUTION APPROVING EXECUTION OF THE EAST BAY <br />DISCHARGERS AUTHORITY AGREEMENT BY THE LIVERMORE- <br />AMADOR VALLEY WATER MANAGEMENT AGENCY <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton is a member of the Livermore-Amador <br />Valley Water Management Agency, a joint powers agency <br />created to implement a wastewater disposal program in the <br />Livermore-Amador Valley; and <br /> <br />WHEREAS, <br /> <br />the Livermore-Amador Valley Water Management Agency has <br />approved the construction of a pipeline to remove treated <br />effluent from the Livermore-Amador Valley by disposing of <br />the same into a pipeline to be constructed by the East Bay <br />Dischargers Authority; and <br /> <br />WHEREAS, <br /> <br />the Livermore-Amador Valley Water Management Agency has <br />negotiated with East Bay Dischargers Authority for rights to <br />dispose of treated effluent into the East Bay Dischargers <br />Authority system; and <br /> <br />WHEREAS, <br /> <br />the proposed agreement between East Bay Dischargers Authority <br />and the Livermore-Amador Valley Water Management Agency was <br />referred to the respective counsels of the Agency for their <br />review on approval prior to execution by the Agency; and <br /> <br />WHEREAS, <br /> <br />the City Council, at its meeting of January 10, 1978, con- <br />sidered the East Bay Dischargers Authority - Livermore-Amador <br />Valley Water Management Agency Agreement. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE <br />AS FOLLOWS: <br /> <br /> Section 1. Approves a favorable vote by the Pleasanton representatives <br /> on the Livermore-Amador Valley Water Management Agency Board <br /> in favor of the execution by Livermore-Amador Valley Water <br /> Management Agency of an agreement with East Bay Dischargers <br /> Authority dated February 1, 1978 subject to changes to <br /> Paragraphs 12 and 18 of the East Bay Dischargers Authority <br /> Agreement as more particularly set forth by the General <br /> Counsel for Livermore-Amador Valley Water Management Agency. <br /> <br /> Section 2.
