CITY COUNCIL <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RE: <br /> <br /> RESOLUTION NO. 79-10 <br />COUNCIL DETERMINATION ON AP-~-14 - APPEAL OF A <br />MITIGATED NEGATIVE DECLARATION FOR VARIANCE FOR <br />THE SUBDIVISION OF PROPERTY NEAR OAKLAND AVENUE <br />AND MOHR AVENUE <br /> <br />WHEREAS, <br /> <br />the Board of Adjustment of the City of Pleasanton received <br />a request to allow the subdivision of a 21-acre parcel of <br />land located about 500 feet north of Mohr Avenue into four <br />lots, one of which would not have the required lot width <br />and two of which would not have the required lot size <br />for their zoning district; and <br /> <br />WHEREAS, <br /> <br />in considering that request, the Board of Adjustment re- <br />ceived a proposed negative declaration from staff finding <br />that no significant impacts on the environment would be <br />created by the project, and thus, a negative declaration <br />should be prepared; and <br /> <br />WHEREAS, <br /> <br />the Board of Adjustment, in considering the negative declara- <br />tion, concluded that item 5, Water Related Impacts, of the <br />environmental assessment should be modified to show the <br />Water Related Impacts as insignificant if mitigated; and <br /> <br />WHEREAS, in order to mitigate that impact, the Board of Adjustment <br /> added the following condition: <br /> <br />"It will be necessary for studies to be conducted <br />as part of the subdivision of the property and/or in <br />conjunction with consideration of septic tanks on the <br />site to demonstrate that the underground water supply <br />will not be contaminated by any septic tanks allowed <br />on the subject property~" and <br /> <br />WHEREAS, <br /> <br />Ray Kidder and Anna Martinsen appealed the decision of <br />the Board of Adjustment approving the mitigated declaration; <br />and <br /> <br />WHEREAS, the City Council held a public hearing on January 23, 1979 <br /> to consider said appeal; and <br /> <br />WHEREAS, the City Council received staff reports and extensive <br /> testimony both for and against the appeal; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1. That the condition relating to septic tanks be modified <br /> to read as follows: <br /> <br />"That prior to the filing of the subdivision map on <br /> <br /> <br />
