CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 79-5 <br /> <br />A RESOLUTION DENYING THE APPLICATION OF NUCLEAR <br />ENGINEERING COMPANY FOR A CONDITIONAL USE PERMIT <br />FOR A RADIOACTIVE AND CHEMICAL WASTE STORAGE <br />FACILITY AT 7164 JOHNSON DRIVE. <br /> <br />WHEREAS , <br /> <br />Nuclear Engineering Company made application (UP-78-34) <br />for a conditional use permit to operate a radioactive <br />and chemical waste storage facility at 7164 Johnson <br />Drive; and <br /> <br />WHEREAS, <br /> <br />the facility would serve as an office and warehouse for <br />the temporary storage of low level radioactive waste and <br />chemical waste; and <br /> <br />WHEREAS, the Planning Commission on December 13, 1978 voted to <br /> approve the conditional use permit; and <br /> <br />WHEREAS, that approval was appealed to the City Council; and <br /> <br />WHEREAS, <br /> <br />the City Council received a staff report, minutes of <br />the Planning Commission action, and held a public hearing <br />on January 9, 1979 to receive comments from the applicant <br />and the public. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL RESOLVES AS FOLLOWS: <br /> <br />Section 1. The Council is unable to make the findings required <br /> by Section 2-5.12 and 2-11.08 of the Ordinance Code, in <br /> particular findings (a) and (b) required by Section 2-11.08, <br /> because of the following: <br /> <br />(1) The location of the proposed nuclear and chemical <br /> waste facility would be detrimental to the properties <br /> and improvements in its vicinity in that other industrial <br /> tenants would be less likely to locate in the area near <br /> to a chemical and nuclear waste storage facility; <br />(2) The location could also be detrimental to public <br /> health and welfare in that the facility would share <br /> a building, housing a printing plant with flammable <br /> chemicals and it would be close by the interstate <br /> freeway; and <br />(3) the location of the proposed use, adjacent to 1-680 <br /> freeway and near the entrance to the City is not in <br /> accord with the objectives of the zoning chapter in <br /> particular objectives (d) of Section 2-4.01: "to <br /> insure that...lands ultimately are used for the <br /> purposes which are most appropriate and beneficial <br /> from the standpoint of the City as a whole." <br /> <br /> <br />
