CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 79-24 <br /> <br />A RESOLUTION MAKING APPLICATION TO ALAMEDA COUNTY LOCAL <br />AGENCY FORMATION COMMISSION REQUESTING INITIATION OF <br />PROCEEDINGS FOR PROPOSED ANNEXATION NO. 73 PURSUANT TO <br />THE MUNICIPAL ORGANIZATION ACT OF 1977 <br /> <br />WHEREAS, pursuant to the Municipal Organization Act of 1977, beginning with Section <br /> 35000 of the Government Code, an affected city, as therein defined, may, <br /> by resolution adopted by its legislative body, make a proposal for an <br /> "island annexation" and request initiation of proceedings thereon; and <br /> <br />WHEREAS, the City of Pleasanton is an "affected city" for an annexation proposal <br /> which contains territory proposed to be annexed as part of said City. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: <br /> <br />Section 1. This City Council, as the legislative body of an affected City, does <br /> hereby make a proposal for annexation pursuant to the Municipal Organiza- <br /> tion Act of 1977 and does hereby request proceedings pursuant to such act. <br /> <br />Section 2. The annexation shall consist of the following change in organization: <br /> <br />That 46 acre, more or less, area adjacent to Stanley Boulevard <br />betweenMain Street and First Street, more specifically defined <br />as bounded by the existing City Limits on the north (the north- <br />ern Western Pacific Railroad right-of-way boundary), west, and <br />south, and by the eastern boundary of the Southern Pacific Rail- <br />road right-of-way on the east, shall be changed from unincorpor- <br />ated Alameda County lands to land within the City of Pleasanton. <br /> <br />Said territory is found to be inhabited and is more specifically described <br />in Exhibit "A", attached hereto and incorporated herein. <br /> <br />Section 3. This City Council does hereby declare that its reasons for proposing <br /> this annexation are: <br /> <br />The area is substantially surrounded by the City, is substantially <br />developed, is receiving City services and benefits already and will <br />further benefit from additional City services which would be pro- <br />vided per City standards; the area would receive full City services. <br /> <br />Section 4. A certified copy of this resolution shall be transmitted to the Alameda <br /> County Local Agency Formation Conunission. <br /> <br />Section 5. This resolution shall become effective Immediately upon its passage and <br /> adoption. <br /> <br />THIS RESOLUTION ADOPTED ON FEBRUARY 13, 1979, BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers <br />NOES: Mayor Mercer <br />ABSENT: None <br /> <br />Brandes, Butler, Kephart, and Wood <br /> <br /> <br />
