12 <br /> THE CITY OF <br /> ,Q <br /> CITY COUNCIL AGENDA REPORT <br /> pLEASANTON <br /> February 18, 2020 <br /> Library and Recreation <br /> Community Development <br /> TITLE: CONSIDER INTRODUCTION OF AN ORDINANCE TO AMEND CHAPTER <br /> 9.32 AND TITLE 18 OF THE MUNICIPAL CODE TO: RESTRICT THE SALE <br /> OF FLAVORED TOBACCO AND ELECTRONIC SMOKING DEVICES; <br /> RESTRICT TOBACCO SALES WITHIN 1,000 FEET OF PUBLIC <br /> SCHOOLS, PARKS AND RECREATION FACILITIES; REQUIRE <br /> TOBACCO RETAILER LICENSING; AND ADDRESS POSSESSION OF <br /> TOBACCO PRODUCTS BY PERSONS UNDER 21 <br /> SUMMARY <br /> After learning about the high rates of underage usage of flavored tobacco products and <br /> e-cigarettes in Alameda County, as well as the influence of tobacco advertising and <br /> exposure on children, the Youth Commission recommended that the City Council adopt <br /> ordinances to restrict the sale of various tobacco products. Such restrictions are being <br /> adopted by other communities in the Tri-Valley and Alameda County. The Economic <br /> Vitality Commission, Human Services Commission, and Planning Commission have <br /> considered the Youth Commission's recommendations and made their own <br /> recommendations regarding local tobacco restrictions. Retailers and the public also <br /> have been engaged in this discussion at eight public meetings and hearings on this <br /> topic. Based on this input, staff has formulated a recommendation for City Council <br /> consideration that seeks to limit access and exposure to tobacco products, particularly <br /> for youth, without unduly impacting existing businesses and adult consumers. <br /> RECOMMENDATION <br /> Introduce an ordinance to amend Municipal Code Chapter 9.32 and Title 18 to: <br /> 1 . Prohibit the sale of flavored tobacco products by tobacco retailers (grocery <br /> stores, gas stations, convenience stores, etc. where tobacco sales are incidental <br /> to other uses/sale of products), but allow sales by tobacco stores (where 60% or <br /> more of revenue is from tobacco products and paraphernalia, and store entry is <br /> age-restricted) <br /> 2. Prohibit the sale of electronic smoking devices and paraphernalia by tobacco <br /> retailers, but allow sales by tobacco stores <br /> 3. Prohibit tobacco sales by new tobacco retailers and new tobacco stores within <br /> 1,000 feet of public schools, parks and recreation facilities; existing tobacco <br />
