1 0 <br />ORDINANCE NO. 2171 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />AMENDING MUNICIPAL CODE CHAPTERS 14.04 AND 14.08 TO <br />INCORPORATE THE WATER SUBMETER REQUIREMENT FOR MULTIUNIT <br />STRUCTURES FROM SENATE BILL 7 <br />WHEREAS, the California legislature has found that water conservation is more <br />effective when individuals can track their own water usage and makes this possible <br />through a requirement that each dwelling in a multiunit residential structure of two or more <br />dwelling units have an individual water meter or submeter as required by Senate Bill 7 <br />(2016, Wolk); and <br />WHEREAS, amendments are needed to the municipal code to incorporate the <br />submetering requirements of SB 7. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DOES HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Finds that changes to the Municipal Code incorporating submetering <br />requirements for multiunit residential structures as required by SB 7 have no possibility <br />to have a significant effect on the environment per Title 14 California Code of Regulations <br />§15061(b)(3). <br />SECTION 2. Adopts amendments to Municipal Code Chapters 14.04 Regulation <br />of Water System and Water Service Fees and 14.08 Water Connections as shown in the <br />attached Exhibit A. <br />SECTION 3. Finds that consistent with Municipal Code § 14.04.050.B and the new <br />California Water Code § 537.1(a), for purposes of determining the applicability of SB 7, <br />"an application for a water connection" shall be the earlier of the date when a person first <br />submits for a building permit or for an encroachment permit for a multiunit residential <br />structure. <br />SECTION 4. A summary of this ordinance shall be published once within <br />fifteen (15) days after its adoption in "The Valley Times", a newspaper of general <br />circulation published in the City of Pleasanton, and the complete ordinance shall be <br />posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br />adoption. <br />SECTION 5. This ordinance shall be effective January 1, 2018. <br />
