01-25-84/net - 3263S <br />THIS AGREEMENT, made and entered into this ~ day of <br />1984, by and between the .CITY OF PLEASANTON, a <br />municipal corporation, hereinafter called "City", and PACIFIC <br />BELL, a California corporation, hereinafter called "Pacific". <br />WITNESSETH: <br />WHEREAS, on February 23, 1982, the City Council of City <br />under the authority of the Municipal Improvement Act of 1913 <br />adopted Resolution No. 82-75 entitled "Resolution of Intention <br />to Order Improvement in Assessment District 1982-1" wherein <br />City finds that the land specially benefited by the <br />improvements is shown within the boundaries of the map <br />entitled, "Proposed Boundaries of Assessment District 1982-1. <br />City of Pleasanton, Alameda County, California"; and therefore. <br />established Assessment District 1982-1, hereinafter called <br />"District"; and <br />WHEREAS, on March 8, 1983, the City Council of City <br />adopted Resolution No. 83-82 entitled "Resolution Amending <br />Resolution of Intention Assessment District 1982-1, Dublin <br />Canyon Road Improvements". Wherein the City Council of City <br />resolves: This Council intends to order the improvements under <br />the authority of The Municipal Improvement Act of 1913; and <br />WHEREAS, this Agreement is entered into pursuant to the <br />provisions of Section 10110 of the California Streets and <br />Highways Code; and <br />WHEREAS, all property owners in the District are or will <br />be required by ordinance or other legislation, or all have <br />agreed or will agree to provide and maintain the underground <br />
