Box 520 <br />Pleasanton, CA 94566 <br />GROWTH MANAGEMENT AGREEMENT <br />THIS GROWTH MANAGEMENT AGREEMENT is made and entered into on <br />the 4th day of August, 1992, by and between WILLIAM L. CURRIN and <br />BETTY J. CURRIN; MILTON HURRAY; CYNTHIA KERWIN SMITH; and JOHN N. <br />HUNTER and JOSEPHINE A. HUNTER, (hereinafter referred to as <br />"Developer"), and the CITY OF PLEASANTON, a municipal corporation <br />(hereinafter referred to as "City"). <br />R E C I T A L S: <br />A. Developer owns real property in the City of Pleasanton <br />described in Exhibit A, attached to this Agreement and made a <br />part of it by reference, hereinafter referred to as the "Subject <br />Property." <br />B. The City has granted to Developer development plan <br />approval for 54 dwelling units, hereinafter referred to as the <br />"Project . " <br />C. Developer is seeking growth management approval for the <br />Project under the City's Growth Management Program. <br />D. City may enter into growth management agreements with <br />project developers meeting the requirements for such agreements <br />pursuant to the City's Growth Management Program Ordinance, a <br />copy of which is attached hereto as Exhibit B. <br />E.~ City and Developer wish to enter into a growth <br />management agreement in order to achieve the benefits of the <br />Project to City and its residents and in accordance with the <br />purposes of Section 17.36.200 of the Pleasanton Municipal Code. <br />NOW, THEREFORE, in consideration of the mutual promises <br />expressed herein, City and Developer hereby agree as follows: <br />I. GROWTH MANAGEMENT APPROVAL <br />City hereby grants growth management approval to the Project <br />for development according to the following schedule: <br />1993 20 units <br />1994 20 units <br />1995 14 units <br />- 1 - <br />
