Box 520 <br />Pleasanton, CA 94566 <br />Attn: City Clerk <br />REIMBURSEMENT AGREEMENT <br />FOR SEWER IMPROVEMENTS <br />This Agreement ("Agreement") is entered into this ~~day of ~ ~.2~-7J 1 <br />2001, by and between the CITY OF PLEASANTON, a municipal corporation ("City") <br />and THOMAS & ALETA MESSA (collectively "Owners"). <br />RECITALS <br />A. Owners are the owners of certain real property located in the City of <br />Pleasanton, County of Alameda, State of California, commonly known as follows: <br />Thomas & Aleta Messa 3626 Vine Street <br />B. Thomas & Aleta Messa received approval and constructed a 6" inch sanitary <br />sewer line along a portion of Vine Street, a distance of approximately two hundred and <br />sixty (260) linear feet ("Improvement"), as described more particularly in the attached <br />Exhibit "1 ", incorporated herein by this reference. <br />C. The following property owners ("Paid Property Owners") in the area have <br />paid the Messas and connected to the Improvements: <br />Ken & Cindy Nielsen 3644 Vine Street <br />Mark Porter 3608 Vine Street <br />Arlene Mckee 3631 Vine Street <br />Deanna Smith & Steve Owens 415 Linden Way <br />C. The Improvement contains supplemental size and capacity which benefits <br />other anticipated development on nearby property. <br />D. Owners and Paid Property Owners have each paid one-sixth of the cost of the <br />Improvement (excepting McKee which paid two-sixths for two lots), and are each <br />entitled to reimbursement for that portion of the costs of the Improvement, on a pro-rata <br />basis, from any other property which utilizes the Improvement. <br />NOW, THEREFORE, in exchange for mutual consideration, the receipt and value <br />of which is hereby acknowledged, the parties agree as follows: <br />
