REAL PROPERTY PURCHASE CONTRACT - CITY OF PLEASAIdTON <br />THIS AGREEMENT is made and entered into this p~7~-'~ day <br />of August, 1984, by and between LAVER~dE and GEORGE MARZ~ENT <br />(hereinafter "Purchaser") and the CITY OF PLEASANTON, a <br />municipal corporation (hereinafter "City"). <br />W I T N E S S E T H <br />~J~IEREAS, City is the owner of a 3.,700 square foot <br />parcel of land located on the northwest corner of Peters <br />Avenue and Bernal Avenue, which is a remnant of a lot purchased <br />for Peters Avenue right-of-way, but not required as part of <br />the new street; and <br />WHEREAS, the 3,700 square foot parcel was declared to <br />be surplus property by Resolution No. 84-114 of the City <br />Council and no authorized governmental agency expressed <br />interest in the property; <br />P1OW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: <br />1. Agreement to Sell and Purchase. City agrees to <br />sell to Purchaser an Purchaser agrees to purchase from <br />City, upon the terms and conditions set forth herein, all <br />that certain real property (hereinafter the "Surplus Property") <br />situated in the County of Alameda, State of California,: <br />described in Exhibit "A" attached hereto and incorporated <br />herein by reference containing approximately 3,700 square <br />feet. <br />2. Consideration. Purchaser shall pay to City the <br />sum of Eighteen Thousand Five Hundred and No/100ths Dollars <br />($18,500.00). <br />3. C~onveyY~a~n...ce. Upon execution of this Agreement, and <br />fulfillment conditions (a) and (b) of this paragraph, City <br />shall convey to Purchaser the Property by Grant Deed in fee <br />simple, provided that: <br />a. Purchaser agrees that prior to close of <br />escrow Purchaser will submit a parcel map application <br />to City effecting a lot consolidation of the Surplus <br />Property and the adjacent parcels (AP?~ 94-156-12-3 and <br />94-156-12-2). <br />b. Purchaser agrees that prior to close of <br />escrow to install landscaping and a six foot fence all <br />as shown on Exhibit B attached hereto. These improvements <br />are necessary for the benefit of the Peters Avenue <br />-1- <br />
