Box 520 <br />Pleasanton, CA 94566 <br />WATER SERVICE AGREEMENT <br />THIS AGREEMENT is made and entered into this_s~~day of , 199 <br />by and between the City of Pleasanton, a municipal corporation (hereinafter referred to as "City") <br />and Lawrence W. Holmes (hereinafter referred to as "Owner"), based on the following <br />understandings: <br />WITNESSETH: <br />WHEREAS, Owners wish to connect their residence located at Foothill Road (A.P.N. <br />96-290-001-001) to the City water system; and <br />WHEREAS, the property is outside the City's Urban Growth Boundary; and <br />WHEREAS, generally, City policy requires annexation prior to extension of such City <br />services as water facilities; and <br />WHEREAS, City, in accordance with State and LAFCO policies and regulations <br />regarding annexation, either cannot or is unwilling to annex areas outside the City's Urban <br />Growth Boundary; and <br />WHEREAS, the public health, safety, and welfare of the City's residents as well as those <br />in the neighboring community are best served by elimination well water systems and connection <br />to the City water facilities; and <br />WHEREAS, City is willing to extend its water facilities only if there are assurances that <br />the property won't be further subdivided or developed without approval of the City. <br />NOW, THEREFORE, City and Owner hereby agree as follows: <br />1. Provision of Water Service. Owner may connect to City's water systems upon <br />execution of this Agreement. Connection shall be in accordance with the following: <br />(a) Owner shall pay the then-existing water connection fees for connection to <br />the water system in accordance with applicable City ordinances. <br />(b) Owner shall pay all costs associated with extension of the water system to <br />serve Owner's land, said system to be designed in accordance with City <br />standards and subject to City approval. <br />council/holmesagr.sam.sm <br />
