i~ <br />• y <br />SUBDIVISION AGREEMENT <br />TRACT N0. ~• ~~ !91lll~s ~t IG <br />PLEASANTON, ALAMEDA COUNTY, CALIF <br />THIS AGREEMENT made and entered at Pleasanton, California, <br />this \~ul..Y ~~ (fit (o`~ by and between: <br />i ~ 'w ~d.liw~c's, xr. <br />b000 ~~~ A <br />~eloi, ~wli~o~ts <br />hereafter called "subdivider" and the <br />CITY OF PLEASANTON, a general law city, located <br />in Alameda County, California, acting through <br />the City Manager and the City Clerk, <br />hereafter called "City", is subject to the following terms, <br />covenants and conditions: <br />W I T N E S S E T H <br />1. RECITALS. Subdivier has a tentative map for said <br />tract, lying within the boundaries of the City, duly approved <br />by the Planning Commission or the City Council. All or a <br />portion of the area of the tentative map is presented as a <br />"final map", is attached hereto as EXHIBIT A, and is made a <br />part of this agreement. Said map and subdivision of land <br />designates streets, easements and public ways for the City, <br />and subdivider proposes to dedicate this land set forth in the <br />final map to City. As a condition precedent to accepting this <br />offer of dedication by subdivider, City requires the improve- <br />ments of the public ways, installation or extension of certain <br />City services at subdividers expense and certain protections <br />for the City in behalf of the public. This agreement is <br />entered in consideration of those promises by subdivider and <br />the approvai of the map for recording by the City. <br />2. TIME. Time is of the essence of this agreement. <br />The work and improvements required by this agreement shall be <br />completed by subdivider within one (1) year from the above <br />mentioned date of this agreement. The City may extend the <br />time for completion of improvements hereunder, upon good <br />cause being shown by the subdivider. Any such extension may <br />-1- <br />
