OF CALIFORNIA, acting by and through its 3 Department of Transportation, referred to herein as STATE, and ~ C:ITY OF PLEASANTON, a body of politic and a municipal 5 corporation of the State of California, referred to 6 herein as CITY. 'T RECITALS 8 9 (1) STATE contemplates constructing a 5-foot wide 10 sidewalk on the easterly side of San Ramon Road-Foothill Road 11 between Canyon Way and Dublin Boulevard in the vicinity of State 12 Highway Route 5 80 in Dublin and Pleasanton, referred to herein as 13 "PROJECT". 1~F (2) Most of PROJECT is located within STATE's right of 15 way except for the southerly 150 feet which is located on 16 property under the jurisdiction of CITY. 17 (3) CITY is willing to bear the construction cost of 18 said CITY's portion of PROJECT and agreed portions of the 19 preliminary and construction engineering costs thereof. 20 (4) This Agreement sets forth the terms and conditions 21 under which the PROJECT is to be designed, constructed, financed 22 and maintained. 2g * * * * * * * * * * * * 2~ * * * * * * * * * * * * 25 * * * * * * * * * * ~ -1- D~~ATE O~IGINl~l ~ C D8O2 ~
