CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-16 <br /> <br /> RESOLUTION PERMITTING CITY OF PT,/ASANTON <br /> TO JOIN IN AMICUS BRIEF <br /> <br />WHEREAS, there is pending in the Court of Appeal, Fourth <br /> Appellate District, the matter of BIA of San Dieqo <br /> v. Superior Court, in which the Building Industry <br /> Association is challenging the ability of local <br /> jurisdictions to adopt growth management systems; <br /> and <br /> <br />WHEREAS, if the BIA prevails in this matte,r it will impair <br /> cities, like Pleasanton, which have growth <br /> management plans, to plan effectively; and <br /> <br />WHEREAS, the City Attorney of Riverside has volunteered to <br /> write and file the amici curiae (friends of the <br /> court) brief in which other cities may join at no <br /> cost; and <br /> <br />WHEREAS, the City Attorney of Pleasanton has recommended to <br /> the City Council that he be allowed to add the City <br /> of Pleasanton to the amici curiae brief, at no out <br /> of pocket expense to the local taxpayers. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council hereby approves joinder of the <br /> City of Pleasanton in the amici curiae brief of the <br /> City Attorney of Riverside in the case of BIA of <br /> San Dieqo v. Superior Court, pending in the Court <br /> of Appeal, Fourth Appellate District, such <br /> participation to be at no out of pocket expense to <br /> the City of Pleasanton. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
