<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-95-92 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF AMERICA'S BEST <br />KARATE, INC. (ANTHONY CHAN) FOR A CONDITIONAL USE PERMIT TO <br />ALLOW THE OPERATION OF A TAE KWON DO STUDIO AS FILED UNDER <br />CASE UP-95-72 <br /> <br />WHEREAS, America's Best Karate, Inc. (Anthony Chan) has applied for a conditional use <br />permit to allow the operation of a Tae Kwon Do studio in an 1,800 square foot <br />suite located in the Mission Plaza Shopping Center, 1991 Santa Rita Road, <br />Suite B; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C (Commercial) <br />District; and <br /> <br />WHEREAS, at their duly noticed public hearing of November 29, 1995, the Planning <br />Commission considered all public testimony, relevant exhibits and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The Mission Plaza shopping center is zoned for commercial uses allowed <br />and conditionally allowed in the City's C-C zoning district. As stated in <br />the Municipal Code, the uses of this district are intended to work together, <br />supporting each other in order to achieve "an attractive pedestrian <br />shopping area." Conditionally allowed uses, such as gymnasiums and <br />dance studios comparable to the proposed Tae Kwon Do studio, can be <br />found to be consistent with this zoning district, provided they do not <br />generate adverse impacts on the surrounding businesses in the Mission <br />Plaza shopping center. <br /> <br />The proposed Tae Kwon Do studio provides martial arts instruction that <br />would be available to the neighborhood residents living near the Mission <br />Plaza shopping center. <br /> <br />The Tae Kwon Do studio would be operated in a manner -- low voice <br />commands, no music, etc. -- making it compatible with the other <br />office/retail/restaurant businesses located in the shopping center. <br /> <br />II <br /> <br />. <br />
