IMPROVEMENT AGREEMENT 5611 Stonecliff Vista Lane, PLEASANTON, ALAMEDA COUNTY, CALIFORNIA THIS IMPROVEMENT AGREEMENT(the "Agreement") is made and entered at Pleasanton, California,this 2 nc/ day of March, 2021,by and between: Dr. Raquib Khan and Ms. Samia Ara, Co-Trustees of the Raquib Uddin Khan and Sarnia Ismat Ara Living Trust(the "Applicants")and the CITY OF PLEASANTON, a municipal corporation, (the "City"). RECITALS WHEREAS, Applicant received approval from the City Council on September 4, 2007 for a Lot Line Adjustment between Applicant's property at 5611 Stonecliff Vista Lane, also known as Lot 76 of Tract 7374 (APN 947-12-81) and City-owned Parcel C of Tract 7374; and WHEREAS,the City subsequently approved the Lot Line Adjustment as Case No. P20-1055 on December 31, 2000; and WHEREAS, said Lot Line adjustment will transfer approximately 3,300 square feet of land area from City to Applicant; and WHEREAS, as a condition precedent to accepting this propertytransfer City requires ires relocation of existing drainage infrastructure and slope grading within Parcel C on behalf of the public. NOW, THEREFORE, in consideration of the faithful performance of the promises,terms, conditions and covenants set forth herein by Applicant and the approval of the Lot Line Adjustment for recording by the City,the parties hereto agree as follows: 1. Time of Essence. Time is of the essence in the performance of this Agreement. The work and improvements required by this Agreement to be completed by Applicant shall be completed within one (1)year from the above-mentioned date of this Agreement. The City may extend the time for completion of improvements hereunder,upon good cause being shown by the Applicant. Any such extension may be granted without notice to the Applicant's surety, any extension so granted shall not relieve the surety's liability on the bond to secure the faithful performance of this Agreement. 2. Work. Applicant will do or cause to be done and performed the following described work: Improvements pursuant to plans and project bond estimates entitled: a. Construction Plans for"Proposed Property Addition to Lot 76 as shown on the map entitled"Tract 7374, Canyon Oaks property", filed in Book 267 of Maps at Pages 83- 90, Alameda County Records, City of Pleasanton,Alameda County, California", at 5611 Stonecliff Vista Lane, Pleasanton, California, APN 947-12-81, and subsequent IMPROVEMENT AGREEMENT CITY OF PLEASANTON,CALIFORNIA 5611 Stonecliff Vista Lane Page 1 of 7
