RECORDING REQUESTED BY <br />?aND MAIL TO <br /> <br /> (so t. <br /> <br /> DEVELOPMENT AGREEMENT <br />Code Sections 65864-65869.5) <br /> <br /> -033285 <br /> <br /> THZS DEVELOP~,~NT AGREEMENT ("Agreement") is entered into this 29th' <br /> <br /> day of September , 1981, between KAISER FOUNDATION HEALTH PLAN, INC., <br /> <br />a California nonprofit corporation ("Property Owner"), and the CITY OF <br />PLEASANTON ("City"), a municipal corporation organized and existing under <br />the laws of the State of California. <br /> <br /> RECITALS <br /> <br /> This Agreement is predicated upon the following facts: <br /> <br /> 1. Government Code Sections 65864-65869.5 authorize City to <br /> enter into binding development agreements with persons having legal or <br /> equitable interests in real property for the development of such property; <br /> <br /> 2. Property Owner owns the real property described in Exhibit <br /> A and desires to develop said property as provided in this Agreement~ <br /> <br /> 3. Property Owner has requested City to consider~entering into <br /> a development agreement and proceedings have been taken into accordance <br /> with City's rules and regulations; <br /> <br /> 4. The City Council of City has found that this Development <br /> Agreement is consistent with City's General Plan; <br /> <br /> 5. City recognizes the benefits of the project contemplated <br />hereunder to City and its residents; and <br /> <br /> 6. On S_~_ptember .9~9, 19~1 , the City Council of City adopted <br />Ord±nance No. 998 approving this Development Agreement with Property <br />Cwner and the Ordinance thereafter took effect on October 29 , 1981 . <br /> <br /> In consideration of these factors, and in further consideration to <br />be paid to City by Property Owner of $205 for each dwelling unit equiva- <br />lent ("D.U.E.") sewer permit previously purchased by Kaiser Foundation <br /> <br /> <br />
