CMA-98-109 <br /> <br /> MASTER TRANSPORTATION DEMAND MODEL AGREEMENT <br />FOR USE OF THE ALAMEDA COUNTYWIDE TRAVEL DEMAND MODEL <br />BETWEEN THE ALAMEDA COUNTY CONGESTION MANAGEMENT AGENCY AND <br /> THE CITY OF PLEASANTON <br /> <br />This Agreement is made between the Alameda County Congestion Management Agency, a joint <br />powers agency organized under California law CACCMA"), and the City of Pleasanton, <br />("Jurisdiction"), as of_L~/~,/.~//~q~ . As of March 26, 1~J98, the ACCMA <br />will no longer provide in-house modelingservices for Congestion Management Program (CMP) <br />purposes. These services may be resumed in the future at the Board's direction. The ACCMA <br />will continue as the agency responsible for the upkeep and maintenance of the Alameda <br />Countywide Travel Demand Model ("Countywide Model"). The Countywide Model consists <br />solely of data and supporting information. In conjunction with the separate EMME/2 software, <br />the Countywide Model provides forecasts of the impact of transportation projects and land use <br />changes on traffic in Alameda County. The Countywide Model does not include the EMME/2 <br />software. This software is owned by INRO Consultants, Inc., and must be separately licensed <br />by Jurisdiction and/or any consultant hired by Jurisdiction. The ACCMA will provide, for use <br />by Jurisdiction and/or any consultant hired by Jurisdiction solely for the purposes of, and <br />pursuant to, this Agreement, the Countywide Model EMME/2 data banks, which includes all <br />transportation network and other data inputs and supporting information necessary to run the <br />Countywide Model on EMME/2 and the four step modeling process for CMP purposes. In <br />order for the ACCMA to transfer the data banks and supporting information, Jurisdiction shall <br />agree to the following terms: <br /> <br />1. This Agreement is the master Agreement between the ACCMA and Jurisdiction which details <br />the terms and use of the Countywide Model. The Agreement will be signed once and a copy <br />retained on file with the ACCMA and Jurisdiction. For each individual project or new proposed <br />use of the Countywide Model, a separate letter agreement (sample attached) will be submitted <br />by Jurisdiction to the ACCMA. It is the responsibility of Jurisdiction to ensure that any <br />consultants retained by them have reviewed and agree to the terms of the Master Agreement. <br />The associated consultants will be required to sign the letter agreement. Consultants retained <br />by Jurisdiction must demonstrate through previous work experience and references their ability <br />to operate the EMME/2 model hardware and software. It is the responsibility of Jurisdiction <br />to verify consultant capabilities, which shall be used for CMP purposes only. <br /> <br />2. The Countywide Model data banks and supporting information will be used for analysis of <br />projects and transportation impacts within the study area only. The Countywide Model will not <br />be used to analyze the impacts of any network, land use or other changes outside of the project <br />study area or for any purpose other than that listed in the letter agreement submitted under <br />separate cover unless prior written agreement is obtained from the ACCMA. Jurisdiction will <br />document with each CMP submittal it makes, the changes made to the content of the Countywide <br />Model. Any non-project related modifications need to have written approval from the ACCMA. <br />All documentation utilizing Countywide Model results will cite the Countywide Model as its <br />source and will be produced under the direction of and signed by Jurisdiction. <br /> <br /> <br />
