<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-75 <br /> <br />RESOLUTION RECOMMENDING THAT THE MERRITT PROJECT (PUD-96-l4) BE <br />CONSIDERED AS A "FIRST-COME, FIRST-SERVED" PROJECT FOR PURPOSES OF <br />GROWTH MANAGEMENT ALLOCATIONS <br /> <br />WHEREAS, the DeSilva Group has applied for Planned Unit Development pre-zoning to <br />PUD-LDR (Planned Unit Development - Low Density Residential) and <br />development plan approval to allow 91 single-family homes on approximately 46 <br />acres located between Foothill Road and Interstate 680 adjoining the Foothill <br />Knolls subdivision to the south and the Foothill Farms subdivision to the north; <br />and <br /> <br />WHEREAS, at its duly noticed public hearing of September 23, 1998, the Planning <br />Commission, after considering all public testimony, relevant exhibits, and <br />recommendations ofthe City staff, recommended approval of an 89-lot <br />single-family home subdivision on the subject site; and <br /> <br />WHEREAS, the Growth Management Ordinance requires that a new development under 100 <br />units must either be phased over a three-year period if it is to be considered as a <br />major project, or ifthe development is determined to be a "first-come, <br />first-served" project, no specific yearly allocations are granted, and the developer <br />would be able to obtain up to 35 units per year; and <br /> <br />WHEREAS, the Planning Commission determined that classifYing the proposed project as a <br />"first-come, first-served" project would be in accordance with the intent ofthe <br />City's Growth Management Ordinance. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Recommends that the project as proposed by the DeSilva Group for 89 <br />single-family homes on approximately 46 acres located between Foothill Road <br />and Interstate 680 adjoining the Foothill Knolls subdivision to the south and the <br />Foothill Farms subdivision to the north be classified as a "first-come, first-served" <br />project for the purposes of Growth Management allocations. <br /> <br />Section 2. <br /> <br />This resolution shall become effective immediately upon its passage and adoption. <br />
