September 15, 2009 September —172609 2663 Police Department Office of the City Attorney TITLE: ADOPT A RESOLUTION AMENDING THE MASTER FEE SCHEDULE RELATED TO PARKING CITATION PENALTIES AND INTRODUCE AN ORDINANCE AMENDING CHAPTER 1.12 (GENERAL PENALTY) AND CHAPTER 11.38 (RESIDENTIAL PERMIT PARKING ZONE) OF THE PLEASANTON MUNICIPAL CODE SUMMARY In 2008, the State Legislature enacted Senate Bill 1407 to provide, in part, for enhanced revenues to finance new construction and renovation projects of court facilities throughout California by increasing the penalties collected for each parking citation. Prior to SB 1407, state law required that Pleasanton remit to Alameda County $5.00 for each parking citation collected to finance state courthouse and criminal justice facility (i.e., jail) construction. SB 1407 increased the amount to $9.50. SB 1407's adoption prompted staff to review the City's current parking citation penalties and as a result of that review, staff is recommending amending the Master Fee Schedule related to parking violations and amending the Municipal Code to consolidate parking penalties in the General Penalty Chapter (PMC Chapter 1.12). RECOMMENDATION Adopt the attached resolution that amends the Master Fee Schedule, effective immediately, to revise the parking penalties and add additional parking penalties. Introduce the attached ordinance to revise Municipal Code Chapter 1.12 (General Penalty) and Chapter 11.38 (Parking Permit) to consolidate parking penalties in Chapter 1.12. FINANCIAL STATEMENT Based on the average number of parking citations issued in a year by the Police Department (i.e., approximately 1,000 citations), the adoption of the attached resolution will annually increase parking citation penalty revenues approximately $25,000.
