2 <br /> THE CITY OF <br /> pL£ASANTONo CITY COUNCIL AGENDA REPORT <br /> July21, 2009 <br /> Law Department <br /> TITLE: CERTIFICATION OF TAXES AND ASSESSMENTS CONCERNING <br /> PROPOSITION 218 <br /> SUMMARY <br /> Every year cities throughout Alameda County request the County to place on upcoming <br /> property tax bills certain taxes and /or assessments levied by the cities. The County <br /> requires the cities to certify that these taxes and assessments comply with Proposition <br /> 218 before placing the items on the tax bill. The County also wants to be indemnified to <br /> the extent there is a legal challenge to any of the taxes or assessments. The attached <br /> resolution makes the necessary certification and authorizes the City Attorney to sign the <br /> attached Certification and Mutual Indemnification. <br /> RECOMMENDATION <br /> Adopt the attached resolution certifying that the taxes and assessments that the City will <br /> request the County to place on the 2009/2010 tax rolls meet the requirements of <br /> Proposition 218 and authorizing the City Attorney to sign the Certification and <br /> Indemnification Agreement. <br /> FINANCIAL STATEMENT <br /> If one of the assessments were challenged, the City would incur legal costs to defend the <br /> challenge; we would also be responsible for any judgment imposed on the County as a <br /> result of the City's failure to comply with Proposition 218. <br />
