<br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. 1458 <br /> <br />ORDINANCE APPROVING CASE PUD-89-5-1D, THE <br />APPLICATION OF THE DESILVA GROUP FOR DEVELOPMENT <br />PLAN APPROVAL <br /> <br />WHEREAS, the DeSilva Group has applied for PUD development <br />plan approval to construct a 251 unit single-family <br />residential project and related improvements to be <br />located on an approximately 136 acre site located <br />at the northeast corner of the intersection of <br />Bernal Avenue and Foothill Road: and <br /> <br />WHEREAS, zoning for the property is PUD (Planned unit <br />Development) - Low Density Residential District: <br />and <br /> <br />WHEREAS, an Environmental Impact Report was approved in <br />conjunction with the PUD master plan approval for <br />the subject property (PUD-89-5). Therefore, this <br />application is not considered to be a new project <br />under the California Environmental Quality Act <br />(CEQA), and no environmental document accompanies <br />this case: and <br /> <br />WHEREAS, Council received the Planning Commission'S <br />recommendations for approval of the proposed <br />development plan: and <br /> <br />WHEREAS, the City Council finds that this development plan <br />is in conformance with Case PUD-89-5, the approved <br />PUD master plan for the subject site. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br />Section 1: Approves the development plan to construct a 251 <br />unit single-family residential project and related <br />improvements to be located on an approximately 136 <br />acre site located at the northeast corner of the <br />intersection of Bernal Avenue and Foothill Road <br />subject to the conditions shown on Exhibit "All, <br />attached hereto and made part of this case by <br />reference. <br /> <br />Section 2: This ordinance shall be published once within <br />fifteen (15) days after its adoption in "The Tri- <br />Valley Herald," a newspaper of general circulation <br />published in the City of Pleasanton. <br />
