CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1458 ORDINANCE APPROVING CASE PUD-89-5-1D, THE APPLICATION OF THE DESILVA GROUP FOR DEVELOPMENT PLAN APPROVAL WHEREAS, the DeSilva Group has applied for PUD development plan approval to construct a 251 unit single-family residential project and related improvements to be located on an approximately 136 acre site located at the northeast corner of the intersection of Bernal Avenue and Foothill Road: and WHEREAS, zoning for the property is PUD (Planned unit Development) - Low Density Residential District: and WHEREAS, an Environmental Impact Report was approved in conjunction with the PUD master plan approval for the subject property (PUD-89-5). Therefore, this application is not considered to be a new project under the California Environmental Quality Act (CEQA), and no environmental document accompanies this case: and WHEREAS, Council received the Planning Commission'S recommendations for approval of the proposed development plan: and WHEREAS, the City Council finds that this development plan is in conformance with Case PUD-89-5, the approved PUD master plan for the subject site. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Approves the development plan to construct a 251 unit single-family residential project and related improvements to be located on an approximately 136 acre site located at the northeast corner of the intersection of Bernal Avenue and Foothill Road subject to the conditions shown on Exhibit "All, attached hereto and made part of this case by reference. Section 2: This ordinance shall be published once within fifteen (15) days after its adoption in "The Tri- Valley Herald," a newspaper of general circulation published in the City of Pleasanton.
