CITY COUNCIL CITY OF PI~ASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1491 <br /> <br /> AN ORDINANCE APPROVING THE APPEAL (AP-90-15) OF CASE PUD- <br /> 90-13, THE APPLICATION OF S & S PROPERTIES (WESTBROOK) <br /> <br />WHEREAS, at its meeting of October 24, 1990, the Planning <br /> Commission reviewed the application of S & S Properties <br /> for rezoning from "A" (Agricultural) to the "PUD (Planned <br /> Unit Development) - Medium Density Residential" District <br /> and for development plan approval to construct 40 single <br /> family residential units on an approximately 9 acre site <br /> located at 10890 Dublin Canyon Road; and <br /> <br />WHEREAS, zoning for the property is A (Agricultural) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal <br /> Code, S & S Properties submitted an appeal to the City <br /> Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, a public hearing was held before the City Council on <br /> November 20, 1990 at which time all pertinent testimony <br /> and documents were reviewed; and <br /> <br />WHEREAS, after hearing all interested persons and receiving and <br /> considering all relevant evidence, the City Council makes <br /> the following findings: <br /> <br /> 1. That the project is in the best interests of the <br /> public health, safety, and general welfare; <br /> <br /> 2. The project is consistent with the City's General <br /> Plan; <br /> <br /> 3. The plan is compatible with previously-developed <br /> properties in the vicinity and the natural, <br /> topographic features of the site; <br /> <br /> 4. The grading takes into account environmental <br /> characteristics and is designed in keeping with the <br /> best engineering practices to avoid erosion, slides <br /> or flooding to have a minimal effect upon the <br /> environment as possible; <br /> <br /> 5. The streets and buildings have been designed and <br /> located to complement the natural terrain and <br /> landscape; <br /> <br /> <br />
