CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALA}~DA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-20 <br /> <br />WHEREAS, <br /> <br />RESOLUTION APPROVING STIPULATED SETTLEMENT OF <br />CITY OF PLEASANTON vs. CITY AND COUNTY OF SAN <br />FRANCISCO AND AMENDING BUDGET - <br /> <br />the City of Pleasanton filed ac0m~laint in eminent <br />domain, Action No. H-55397-5, in o~de~ to acquire <br />approximately 0.59+ acres of permanent ea~e~nent across <br />the land of the CiTy and County of San Francisco <br />commonly described as Alameda County Assessor's Parcels <br />946-3650-1-3, 946-3650-1-9 and 946-517-5-4 and a <br />temporary construction easement of .093 acres adjacent <br />to said permanent easement; and <br /> <br />WHEREAS, <br /> <br />the City and County of San Francisco and the City of <br />Pleasanton have negotiated a stipulated judgment <br />settling the matter for the approximate appraised <br />values of said easements. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Authorizes the filing in the Alameda Superior Court <br /> of a stipulated judgment between the City of Pleasanton <br /> and the City and County of San Francisco by which the <br /> City of Pleasanton shall pay $7,300 plus interest at <br /> 7% to the date of judgment for said lands. <br /> <br />Section 2: Authorizes amending the budget of the City of <br /> Pleasanton to provide for any additional money necessary <br /> to pay for said easements. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JANUARY 27, 1981 BY THE FOLLOWING VOTE: <br /> <br />NOES: None ~R~21E <br />ABSENT: None <br />ABSTAIN: None <br /> R, MAYORTH <br /> TEST: <br /> <br />By Doris George, Deputy City Clerk <br /> <br />APPROVED AS TO FORM: <br /> <br />~Levine, City Attorney <br /> <br /> <br />
