CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 81-247 P~SOLUTION APPROVING NEGATIVE DECLARATION FOR REZONING A ONE ACRE SITE LOCATED AT 5130 FOOTHILL ROAD FROM A (AGRICULTUP~L) TO R-I-40,000 DISTRICT ~{EREAS, at its meeting of July 14, 1981, the City Council received a proposed negative declaration for rezoning a 5.1 acre site located at 5130 Foothill Road from A (Agricultural) District to the R-i-40,000 District; and the City Council has received and reviewed the Initial Study dated May 29, 1981 and received the recommendations of the staff and Planning Commission; and WHEREAS, a duly noticed public hearing was held at which time the public was given the opportunity to comment on the proposed environmental assessment; and WHEREAS, the City Council has reviewed the potential impacts in accordance with the applicable state and local guidelines governing the preparation of Negative Declarations and Environmental Impact Reports; and WHEREAS the City Council upon review of the application decided that the applicant's intent could be accomplished by rezoning only one acre of the property, which would also eliminate the possibility of the property being subdivided in the future on land which evidence indicates may be unstable; and WHEREAS the City Council finds that the proposed rezoning would not have any significant adverse effects on the environment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: That a Negative Declaration be adopted for the rezoning of a one acre site located at 5130 Foothill Road from A (Agricultural) District to the R-i-40,000 District.
