CITY COUNCIL OF THE CITY OF PLEASA~ON <br /> <br />ALAMEDA COUi~Y, CALIFORNIA <br /> <br />RESOLUTION NO. 81-262 <br /> <br />RESOLUTION APPROVING MITIGATED NEGATIVE DECLARATION <br />FOR DEVELOPMENT PLAN APPROVAL FOR AN 81-LOT SINGLE- <br />FAMILY RESIDENTIAL PLANNED UNIT DEVELOPmeNT PROPOSED <br />FOR THE 43 ACRE SITE LOCATED ON THE EAST SIDE OF <br />FOOTHILL ROAD APPROXIMATELY 800 FEET SOUTH OF TIIE <br />CITY LII~IT LINE <br /> <br />WHEREAS <br /> <br />at its meeting of August 11, 1981, the City Council received <br />a proposed mitigated negative declaration for development <br />plan approval for an 81-lot single-family residential <br />Planned Unit Development proposed for the 43 acre site <br />located on the east side of Foothill Road approximately <br />800 feet south of the city limit line; and <br /> <br />WHEREAS <br /> <br />the City Council has received and reviewed the Initial <br />Study dated May 13, 1981 and received the recommendations <br />of the Staff and Planning Commission; and <br /> <br />WItEREAS <br /> <br />a duly noticed public hearing was held at which time the <br />public was given the opportunity to comment on the <br />environmental impacts of the proposed development plan; <br />and <br /> <br />~aIEREAS, <br /> <br />the City Council has reviewed the potential impacts in <br />accordance with the applicable state and local guidelines <br />governing the preparation of mitigated negative declarations <br />and environmental impact reports; and <br /> <br />~{EREAS, <br /> <br />the Initial Study prepared by the City staff indicated <br />that there may be significant impacts upon the environ- <br />ment, but that conditions of approval would render these <br />potential impacts insignificant. <br /> <br />NOW, TI~IIEFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves a Mitigated Negative Declaration for the <br /> development plan approval for an 81-lot single-family <br /> residential Planned Unit Development proposed for the 43 <br /> acre site located on the east side of Foothill Road <br /> approximately 800 feet south of the city limit line, <br /> subject to mitigating conditions number 4, 5, 13, 20, <br /> 22, 27 and 39 as set forth in Exhibit "A" attached to <br /> Ordinance No. 987 and incorporated herein by reference. <br /> <br />Section 2: Council finds that based upon the review of the <br /> Initial Study, and the testimony and documentary <br /> evidence presented at the public hearing that there <br /> may be significant impacts on the environment, but that <br /> conditions listed in Section 1 as mitigations render <br /> these potential impacts insignificant. <br /> <br /> <br />
