CITY COUNCIL OF THE CITY OF PLEASA~ON ALAMEDA COUi~Y, CALIFORNIA RESOLUTION NO. 81-262 RESOLUTION APPROVING MITIGATED NEGATIVE DECLARATION FOR DEVELOPMENT PLAN APPROVAL FOR AN 81-LOT SINGLE- FAMILY RESIDENTIAL PLANNED UNIT DEVELOPmeNT PROPOSED FOR THE 43 ACRE SITE LOCATED ON THE EAST SIDE OF FOOTHILL ROAD APPROXIMATELY 800 FEET SOUTH OF TIIE CITY LII~IT LINE WHEREAS at its meeting of August 11, 1981, the City Council received a proposed mitigated negative declaration for development plan approval for an 81-lot single-family residential Planned Unit Development proposed for the 43 acre site located on the east side of Foothill Road approximately 800 feet south of the city limit line; and WHEREAS the City Council has received and reviewed the Initial Study dated May 13, 1981 and received the recommendations of the Staff and Planning Commission; and WItEREAS a duly noticed public hearing was held at which time the public was given the opportunity to comment on the environmental impacts of the proposed development plan; and ~aIEREAS, the City Council has reviewed the potential impacts in accordance with the applicable state and local guidelines governing the preparation of mitigated negative declarations and environmental impact reports; and ~{EREAS, the Initial Study prepared by the City staff indicated that there may be significant impacts upon the environ- ment, but that conditions of approval would render these potential impacts insignificant. NOW, TI~IIEFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves a Mitigated Negative Declaration for the development plan approval for an 81-lot single-family residential Planned Unit Development proposed for the 43 acre site located on the east side of Foothill Road approximately 800 feet south of the city limit line, subject to mitigating conditions number 4, 5, 13, 20, 22, 27 and 39 as set forth in Exhibit "A" attached to Ordinance No. 987 and incorporated herein by reference. Section 2: Council finds that based upon the review of the Initial Study, and the testimony and documentary evidence presented at the public hearing that there may be significant impacts on the environment, but that conditions listed in Section 1 as mitigations render these potential impacts insignificant.
