CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 81-299 RESOLUTION APPROVING APPEAL OF LONNIE CHASE FOR VARIANCE TO ALLOW RETENTION OF OVER-HEIGHT FENCE AT 4205 ECHO COURT L~nnie'Chase applied to the Board of Adjustment on July 16, 1981 for a variance to allow retention of an over-height fence which encroaches into the required setback of property located at 4205 Echo Court; and WHEREAS, the variance was denied by the Board of Adjustment; and WHEREAS, Mr. Chase has appealed that decision to the City Council; and on September 8, 1981, the City Council reviewed the decision of the Board of Adjustment and the request for variance from Mr. Chase; and WHEREAS, the Council made the following findings: That because of special circumstances applicable to the property, to wit: the difference between the sidewalk fence, the use of the yard for a pool and the pedestrian traffic patterns in the area; the strict application of the provisions of this chapter deprives such property of privileges enjoyed by other properties in the vicinity and under identical zoning classification. That due to the above-noted special conditions, the granting of the variance will not constitute a grant of special privilege inconsistent with the limitation on other properties classified in the same zoning district. That the granting of the variance will enhance the public health, safety, or welfare,and materially benefit the properties or improvements in the vicinity due to increased safety of the residents. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Grants the variance requested by Lonnie Chase and approves his appeal from the decision of the Board of Adjustment thereby allowing the retention of an over- height fence at 4205 Echo Court.
