CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-299 <br /> <br />RESOLUTION APPROVING APPEAL OF LONNIE CHASE FOR <br />VARIANCE TO ALLOW RETENTION OF OVER-HEIGHT FENCE <br />AT 4205 ECHO COURT <br /> <br />L~nnie'Chase applied to the Board of Adjustment on <br />July 16, 1981 for a variance to allow retention <br />of an over-height fence which encroaches into the <br />required setback of property located at 4205 Echo <br />Court; and <br /> <br />WHEREAS, the variance was denied by the Board of Adjustment; and <br /> <br />WHEREAS, Mr. Chase has appealed that decision to the City Council; <br /> and <br /> <br />on September 8, 1981, the City Council reviewed the <br />decision of the Board of Adjustment and the request <br />for variance from Mr. Chase; and <br /> <br />WHEREAS, the Council made the following findings: <br /> <br />That because of special circumstances applicable <br />to the property, to wit: the difference between the <br />sidewalk fence, the use of the yard for a pool and <br />the pedestrian traffic patterns in the area; the <br />strict application of the provisions of this chapter <br />deprives such property of privileges enjoyed by <br />other properties in the vicinity and under identical <br />zoning classification. <br /> <br />That due to the above-noted special conditions, the <br />granting of the variance will not constitute a grant <br />of special privilege inconsistent with the limitation <br />on other properties classified in the same zoning <br />district. <br /> <br />That the granting of the variance will enhance the <br />public health, safety, or welfare,and materially <br />benefit the properties or improvements in the vicinity <br />due to increased safety of the residents. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Grants the variance requested by Lonnie Chase and <br /> approves his appeal from the decision of the Board of <br /> Adjustment thereby allowing the retention of an over- <br /> height fence at 4205 Echo Court. <br /> <br /> <br />
