CITY COUNCIL OF TttE CITY OF PLEASANTON <br /> <br />ALA~EDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-296 <br /> <br />ACCEPTANCE OF BERM REMOVAL, FILLING OF EVAPORATION <br />POND AND SLUDGE BED REMOVAL, PROJECT NO. 81-12, <br />AND APPROVAL OF FINAL PROGRESS PAYMENT TO JOE <br />FOSTER EXCAVATING, INC. <br /> <br />WHEREAS, <br /> <br />work by Joe Foster Excavating, Inc. on the berm removal, <br />filling of evaporation pond and sludge bed removal, <br />Project No. 81-12, has been satisfactorily completed; <br />and <br /> <br />~{EREAS, it is appropriate to authorize the final progress <br /> payment. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The work on the restoration project consisting of <br /> berm removal, filling of evaporation pond and sludge <br /> bed removal is hereby accepted. <br /> <br />Section 2: The Director of Finance is directed to prepare a <br /> warrant in the amount of $72,135 in favor of Joe Foster <br /> Excavating, Inc. in satisfaction of the final progress <br /> payment for the above accepted work on Project i]o. 81-12. <br /> Ten percent (10%) of the total contract or $8,015.00 will <br /> be retained until thirty (30) days after filing of the <br /> Notice of Completion. <br /> <br />Section 3: The City Attorney is directed to file a Notice of <br /> Completion with the Alameda County Recorder. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED SEPTEMBER 8, 1981 BY THE FOLLOWING VOTE: <br /> <br />AYES: - Kephart, Mohr, Wood and Mayor Mercer <br />NOES: ~R~CE~~ <br />ABSENT: <br />ABSTAIN: . <br /> <br />ATTEST: <br /> <br /> I APPROVED AS TO FORM: <br />By Doris George, Deputy City Clerk ~v ~Z~ <br /> ine, City Attorney <br /> <br />Councilmembers <br />None <br />Councilmember Butler <br />None <br /> <br /> <br />
