CITY COUNCIL OF THE CITY OF PLEASANTOi~ <br /> <br />ALAj~DA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-303 <br /> <br />RESOLUTION APPROVING A MITIGATED NEGATIVE DECLARATION <br />FOR DEVELOPr.~NT PLAN APPROVAL FOR A 75-LOT SINGLE- <br />FAMILY RESIDEr~IAL PLANI~D UNIT DEVELOP}~NT TO BE <br />LOCATED ON TIE NORTH SIDE OF VALLEY AVERSE, BETWEEN <br />KOLLN STREET AND TttE SOUTttRN PACIFIC RAILROAD TRACKS <br /> <br />WHEREAS, <br /> <br />at its meeting of September 8, 1981, the City Council <br />received a proposed mitigated negative declaration for <br />development plan approval for a 75-1ot single-family <br />residential planned unit development to be located on <br />the north side of Valley Avenue, between Kolln Street <br />and the Southern Pacific railroad tracks; and <br /> <br />~REAS <br /> <br />the City Council has received and reviewed the Initial <br />Study dated August 4, 1981 and received the recommenda- <br />tions of the Staff and Planning Commission; and <br /> <br />I~tEREAS, <br /> <br />a duly noticed public hearing was held at which time <br />the public was given the opportunity to cormnent on the <br />environmental impacts of the proposed development plan; <br />and <br /> <br />I~HEREAS, <br /> <br />the City Council has reviewed the potential impacts in <br />accordance with the applicable state and local guidelines <br />governing the preparation of mitigated negative declara- <br />tions and environmental impact reports; and <br /> <br />WHER.EAS, <br /> <br />the Initial Study prepared by the City staff indicated <br />that there may be significant impacts upon the environ- <br />ment, but that conditions of approval would render these <br />potential impacts insignificant. <br /> <br />NOW, TI~REFORE, THE CITY COUNCIL OF TtIE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves a Mitigated Negative Declaration for the <br /> development plan approval for a 75-1ot single-family <br /> residential planned unit development to be located <br /> on the north side of Valley Avenue, between Kolln Street <br /> and the Southern Pacific Railroad tracks, subject to <br /> mitigating condition number 2 as set forth in Exhibit "A" <br /> attached to Ordinance No. 996 and incorporated herein by <br /> reference. <br /> <br />Section 2: Council finds that based uDon the review of the <br /> Initial Study, and the testimony and documentary evidence <br /> presented at the public hearing that there may be <br /> significant impacts on the environment, but that conditions <br /> listed in Section 1 as mitigations render these potential <br /> impacts insignificant. <br /> <br /> <br />
