CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-301 <br /> <br />RESOLUTION APPROVING MITIGATED NEGATIVE DECLAt~TION <br />FOR PUD ZONING A~ DEVELOPMENT PLAN APPROVAL FOR A <br />121-UNIT PROJECT PROPOSED FOR 16.1 ACRE SITE LOCATED <br />ON THE EAST SIDE OF MUIRWOOD DRIVE BETWEEN I~EST LAS <br />POSITAS AND LEMONW00D WAY <br /> <br />WHEREAS, <br /> <br />at its meeting of September 8, 1981, the City Council <br />received a proposed mitigated negative declaration for <br />PUD zoning and development plan approval for a 121-unit <br />mixed High Density Residential/Medium Density Residential <br />project proposed for the 16.1 acre site located on the <br />east side of Muirwood Drive between West Las Positas <br />Boulevard and Lemonwood Way; and <br /> <br />~tEREAS, <br /> <br />the City Council has received and reviewed the Initial <br />Study dated August 6, 1981 and received the recommendations <br />of the staff and Planning Commission; and <br /> <br />a duly noticed public hearing was held at which time <br />the public was given the opportunity to comment on the <br />environmental impacts of the proposed development and <br />rezoning; and <br /> <br />the City Council has reviewed the potential impacts in <br />accordance with the applicable state and local guidelines <br />governing the preparation of mitigated negative declara- <br />tions and environmental impact reports; and <br /> <br />WHEREAS, <br /> <br />the Initial Study prepared by the City staff indicated <br />that there may be significant impacts upon the environ- <br />ment, but that conditions of approval would render these <br />potential impacts insignificant. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves a Mitigated Negative Declaration for the <br /> rezoning from A to PUD and approves the development <br /> plan for a 121-unit townhouse/duplex residential complex <br /> proposed to be located on the east side of Muirwood <br /> Drive, between West Las Positas Boulevard and Lemonwood <br /> I~y, subject to mitigating condition number 2 as set <br /> forth in Exhibit "A" attached to Ordinance No. 994 <br /> and incorporated herein by reference. <br /> <br />Section 2: Council finds that based upon the review of the <br /> Initial Study, and the testimony and documentary <br /> evidence presented at the public hearing that there <br /> <br /> <br />
