CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-323 <br /> <br />APPROVING OFF-SITE SANITARY SEWER (STANLEY BOULEVARD <br />TO JENSEN PUMP STATION) REimBURSEMENT AGREE~I~NT <br />WITH FRANK AUF DER MAUR AND KONRAD RICKENBACH <br /> <br />WHEREAS, <br /> <br />Frank Auf Der Maur and Konrad Rickenbach have paid <br />for the construction of an off-site sanitary sewer <br />outfall line from Stanley Boulevard to the Jensen <br />Pump Station, which can serve other properties in the <br />area; and <br /> <br />WHEREAS, <br /> <br />by the reimbursement agreement (a copy of which is <br />attached) those who paid for the sewer are asking <br />the City to collect a proportionate share of the <br />cost of the sewer from owners of property who connect <br />to the sewer in the future; and <br /> <br />WHEREAS, <br /> <br />a copy of the agreement and notice of the hearing on <br />this matter have been sent to all property owners who <br />would be affected by the agreement; and <br /> <br />WHEREAS, <br /> <br />a public hearing was held on September 29, 1981 at which <br />time the affected parties were given an opportunity to <br />comment on the proposed agreement; and <br /> <br />WHEREAS, staff has reviewed the agreement and considers the <br /> proposed cost distribution equitable; and <br /> <br />WHEREAS, <br /> <br />Council has reviewed the proposed reimbursement agreement <br />and the report of the Director of Public Works and <br />Utilities dated September 16, 1981. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF TIM CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves the Reimbursement Agreement with Frank Auf <br /> Der Maur and Konrad Rickenbach regarding the off-site <br /> sanitary sewer outfall line from Stanley Boulevard to <br /> the Jensen Pump Station. <br /> <br />Section 2: Authorizes the appropriate City officials to execute <br /> the agreement. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
