CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 81-323 APPROVING OFF-SITE SANITARY SEWER (STANLEY BOULEVARD TO JENSEN PUMP STATION) REimBURSEMENT AGREE~I~NT WITH FRANK AUF DER MAUR AND KONRAD RICKENBACH WHEREAS, Frank Auf Der Maur and Konrad Rickenbach have paid for the construction of an off-site sanitary sewer outfall line from Stanley Boulevard to the Jensen Pump Station, which can serve other properties in the area; and WHEREAS, by the reimbursement agreement (a copy of which is attached) those who paid for the sewer are asking the City to collect a proportionate share of the cost of the sewer from owners of property who connect to the sewer in the future; and WHEREAS, a copy of the agreement and notice of the hearing on this matter have been sent to all property owners who would be affected by the agreement; and WHEREAS, a public hearing was held on September 29, 1981 at which time the affected parties were given an opportunity to comment on the proposed agreement; and WHEREAS, staff has reviewed the agreement and considers the proposed cost distribution equitable; and WHEREAS, Council has reviewed the proposed reimbursement agreement and the report of the Director of Public Works and Utilities dated September 16, 1981. NOW, THEREFORE, THE CITY COUNCIL OF TIM CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the Reimbursement Agreement with Frank Auf Der Maur and Konrad Rickenbach regarding the off-site sanitary sewer outfall line from Stanley Boulevard to the Jensen Pump Station. Section 2: Authorizes the appropriate City officials to execute the agreement. Section 3: This resolution shall become effective immediately upon its passage and adoption.
