CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-356 <br /> <br />RESOLUTION APPROVING THE STIPULATED SETTLEMENT <br />OF CITY OF PLEASANTON vs. ROMAN CATHOLIC BISHOP <br />OF OAKLAND <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton filed a complaint in eminent <br />domain, Action No. H-55398-1, in order to acquire <br />property necessary for an outfall sewer line and a <br />temporary easement for construction of the line; and <br /> <br />WHEREAS , <br /> <br />the City of Pleasanton and the Roman Catholic Bishop <br />of Oakland have negotiated a stipulated judgment <br />settling the matter for the exchange of permanent easements <br />and the sum of $1,300 plus interest for the use of <br />the temporary easement. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Authorizes the filing in the Alameda Superior Court <br /> of a stipulated judgment between the City of Pleasanton <br /> and the Roman Catholic Bishop of Oakland by which <br /> ermanent easements will be exchanged and the sum of <br /> ~1,300 plus interest at 7% will be paid for the use <br /> of the temporary easement. <br /> <br />Section 2: Authorizes the acceptance of a Grant Deed from the <br /> Roman Catholic Bishop of Oakland to the City of Pleasanton <br /> for a permanent public service easement. <br /> <br />Section 3: The appropriate city official is authorized to <br /> execute a Quitclaim Deed from the City of Pleasanton <br /> to the Roman Catholic Bishop of Oakland for a parcel <br /> of land previously used as a public service easement. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED OCTOBER 13, 1981 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood and Mayor Mercer <br />NOES: None ~ <br />~y Doris George, Deputy C~t~ Clerk ~e ~.~/I.,~ <br /> v~e, C~t~ Attorney <br /> <br /> <br />
