CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-351 <br /> <br />RESOLUTION DENYING THE APPLICATION OF MARSHALL <br />AND LOUISE PERRY TO CONVERT 73 RENTAL UNITS TO <br />CONDOMINIUMS AT 2451 THROUGH 2529 SANTA RITA ROAD <br /> <br />WHEREAS, <br /> <br />Marshall and Louise Perry have applied to the City <br />Council for approval to convert 73 rental units <br />at 2451 through 2529 Santa Rita Road to condominiums; <br />and <br /> <br />WHEREAS, <br /> <br />the Director of Planning and Community Development <br />prepared and submitted a report to the Council dated <br />October 6, 1981 in which he reviewed the project <br />and recommended several conditions should the <br />project be approved; and <br /> <br />WHEREAS, <br /> <br />a duly noticed public hearing was held before the <br />Council at which time members of the public were <br />given the opportunity to speak regarding the <br />proposed conversion; and <br /> <br />WHEREAS, <br /> <br />it was brought to the attention of the Council that <br />the rents in the units proposed for conversion have <br />been raised within the past six months; and <br /> <br />the number of parking spaces provided for the proposed <br />conversion areaare less than that required by Title II, <br />Chapter 2, Article 16, Section 2-9.16. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Denies the application of Marshall and Louise Perry <br /> to convert 73 rental units at 2451 through 2529 Santa <br /> Rita Road to condominiums in that the proposed <br /> conversion fails to meet the requirements of Section <br /> 2-25.10 (b) (Rent Increase Protection) and Section <br /> 2-25.09(c) (Physical Standards) due to lack of <br /> sufficient parking. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED OCTOBER 13, 1981 BY THE FOLLOWING VOTE: <br /> <br /> <br />
