CITY COUNCIL OF THE CITY OF PLEASANTON ALA}~EDA COUNTY, CALIFORNIA RESOLUTION NO, 81-349 RESOLUTION DENYING THE APPEAL OF ROBNETTE STEFFEN OF A DECISION OF TEE BOARD OF ADJUSTI~NT DENYING A VARIANCE FOR AN ICE CREE~ SHOP ~FHEREAS, Robnette Steffen applied to the Board of Adjustment for a variance from the requirements of the Code to allow the operation of an ice cream shop without providing off-street parking; and WHEREAS, the Board of Adjustment, at its meeting of September 1981, considered the application together with the staff report regarding this matter~ and WHEREAS, the Board of Adjustment denied without prejudice Ms. Steffen's application; and WIIEREAS, within the time specified by the Ordinance Code of the City of Pleasanton, the applicant submitted an appeal to the City Council; and WHEREAS, at its meeting of October 13, 1981, the City Council received a report dated October 8, 1981 from the Director of Planning and Community Development together with a copy of the staff report to the Board of Adjustment regarding this matter; and WHEREAS, the City Council held a public hearing at which time the applicant and any member of the public was offered an opportunity to present evidence regarding this appeal; and WHEREAS, the City Council finds that there is no basis to make the findings necessary to grant a variance in that the use of the site is not significantly different or unusual and therefore granting a variance would be a grant of special privilege. NOW, THEREFORE, THE CITY COUNCIL OF TNE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Denies the appeal of Robnette Steffen for a variance to allow the establishment of an ice cream shop at 163 West Neal Street without providing off-street parking for the business. Section 2: This resolution shall become effective immediately upon its passage and adoption.
