CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 81-399 AMENDING RESOLUTION NO. 81-212 DECLARING SURPLUS IN IMPROVEMENT FUND ASSESSMENT DISTRICT NO. 1974-5, STONERIDGE CENTER WHEREAS, on July 14, 1981, the City Council adopted resolution 81-212 setting forth a surplus of $284,299.86 in the improvement fund for Assessment District No. 1974-5; and WHEREAS, there was an error in the amount of money listed in Sections 1 and 2 of that resolution; and WHEREAS, the surplus in the improvement fund should have been listed as $256,934.12, therefore Resolution No. 81-212 is amended in its entirety to read as follows: WHEREAS, On April 22, 1974, the City Council of the City of Pleasanton,Alameda County, California, adopted its Resolution of Intention for public improvements in Assessment District No. 1974-5, Stoneridge Center, City of Pleasanton, Alameda County, California, as later amended; and WHEREAS, said resolution of Intention, as later amended, provided that any surplus in the improvement fund for said assess- ment, after completion of the improvements and payment of all claims from the improvement fund, would be applied in accordance with Section 10427.1 of the Streets and Highways Code of the State of California; and WHEREAS, said improvements have been completed and all claims upon the improvement fund have been paid. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES TO AMEI~ P~SOLUTION 81-212 IN ITS ENTIRETY AS FOLLOWS: Section 1: That a balance of $256,934.12 remains in the improve- ment fund for Assessment District No. 1974-5, Stoneridge Center, City of Pleasanton, Alameda County, California, and that said amount is surplus, as set forth in the Engineer's Final Schedule of Costs attached hereto as Exhibit A, and by reference incorporated herein.
