CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-424 <br /> <br /> A RESOLUTION AUTHORIZING FILING OF CLAIM FOR <br />GRADE SEPARATION FUNDS FROM STATE OF CALIFORNIA <br /> <br />WHEREAS, <br /> <br />the City Council of the City of Pleasanton has been <br />informed of the necessity for the construction of <br />certain proposed grade separation projects and railroad <br />track relocations in the Livermore Valley area between <br />the City of Pleasanton and the unincorporated area of <br />Sunol in the County of Alameda in order to provide for <br />greater public traffic safety; and <br /> <br />WHEREAS, <br /> <br />the City Council previously entered into a joint agreement <br />with the County of Alameda, City of Livermore, and the <br />firm of DeLeuw, Cather and Company on December 29, 1978, <br />for the performance of certain engineering services by <br />said firm in connection with the preliminary planning and <br />design of certain proposed grade separation projects <br />and railroad track relocations; and <br /> <br />WHEREAS, <br /> <br />the City Manager has recommended that he be authorized <br />to have plans and specifications prepared for said grade <br />separation project as a matter in the general public <br />safety and interest; and <br /> <br />WHEREAS, <br /> <br />the City Council has been advised of certain available <br />funding from the State of California in the amount of <br />$5,000,000 in State matching funds for expenditure on the <br />aforesaid proposed project. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1. That the City Manager be hereby authorized and directed <br /> to (1) cause the preparation of plans and specifications <br /> for the aforesaid project; (2) conduct negotiations with <br /> the two involved railroads for appropriate construction <br /> and maintenance agreements; (3) conduct negotiations with <br /> a consulting firm and the County of Alameda for the <br /> preparation and execution of an appropriate final design <br /> engineering services agreement covering the aforesaid <br /> project; (4) seek other possible project funding sources; <br /> (5) prepare necessary funding claim documentation; <br /> (6) file any and all claims with the State of California <br /> on behalf of the City of Pleasanton as required for <br /> payment of the aforesaid grade separation funds as well <br /> as other available funds; and (7) take any other action <br /> required to obtain all funds available for expenditure <br /> on the aforesaid grade separation and railroad track <br /> relocation project. <br /> <br /> <br />
