CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-20 <br /> <br />RESOLUTION APPROVING DEFERRED DEVELOPMZNT AGREEMENT <br />WITH ROBERT E. FRANK <br /> <br />WHEREAS, <br /> <br />Robert E. Frank owns property in the Stoneridge <br />peripheral area, plans for which have not yet <br />been submitted for development approval; and <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />Robert E. Frank acquired sewer connections through <br />the Taubman Company in purchasing the property which <br />on their face would expire prior to the time when <br />development plans eould be completed and building <br />permits issued; and <br /> <br />it is{ikely that the expiration of the sewer <br />permits has been tolled by the significant and <br />continuous construction in the Stoneridge area; <br />and <br /> <br />WHEREAS <br /> <br />entering into a development deferment agreement <br />would additionally protect the life of the sewer <br />permits by precluding receipt of building permits <br />for a specified time pursuant to the 1972 Settlement <br />Agreement; and <br /> <br />WHEREAS <br /> <br />similar agreements have been entered into with <br />Stoneson Development Corporation and TMI; and <br /> <br />WHEREAS <br /> <br />it is in the best interest of the public for the <br />City to enter into this development deferment <br />agreement. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the Development Deferment Agreement <br /> with Robert E. Frank. <br /> <br />Section 2: Authorizes the appropriate City officials to <br /> execute the agreement. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its final passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JANUARY 12, 1982 BY THE FOLLOWING VOTE: <br /> <br /> <br />
