CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-19 <br /> <br />RESOLUTION APPROVING DEFERRED DEVELOPMENT AGREEMENT <br />WITH LEE SAMMIS COMPANY <br /> <br />WHEREAS, <br /> <br />Lee Sammis Company owns property in the Stoneridge <br />peripheral area, a portion of which has been approved <br />for development and a portion of which has not yet <br />been submitted for development approval; and <br /> <br />WHEREAS , <br /> <br />Lee Sammis Company acquired sewer connections through <br />the Taubman Company in purchasing the property which <br />on their face would expire prior to the time when <br />development plans could be completed and building <br />permits issued; and <br /> <br />~IEREAS, <br /> <br />it is likely that the expiration of the sewer permits <br />has been tolled by the significant and continuous <br />construction in the Stoneridge area; and <br /> <br />WHEP~AS, <br /> <br />entering into a development deferment agreement <br />would additionally protect the life of the sewer <br />permits by precluding receipt of building permits <br />for a specified time pursuant to the 1972 Settlement <br />Agreement; and <br /> <br />WHEREAS, similar agreements have been entered into with <br /> Stoneson Development Corporation and TMI; and <br /> <br />WHEREAS, <br /> <br />it is in the best interests of the public for the <br />City to enter into this deferred development <br />agreement. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the Development Deferment Agreement <br /> with the Lee Sammis Company. <br /> <br />Section 2: Authorizes the appropriate City officials to <br /> execute the agreement. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its final passage and adoption. <br /> <br />TItIS RESOLUTION ADOPTED JANUARY 12, 1982 BY THE FOLLOWING <br />VOTE: <br /> <br /> <br />
