CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-11 <br /> <br />RESOLUTION APPROVING THE APPEAL OF TED ~IAVRIDIS <br />OF A DECISION OF THE DESIGN REVIEW BOARD DENYING <br />A PROPOSED TRIPLEX ON SPRING STREET <br /> <br />WHEREAS , <br /> <br />the City CoUncil recently approved an appeal of <br />Ted Mavridis of a decision of the Board of Adjustment <br />denying a variance to allow the construction of a <br />triplex at 276 Spring Street which would not have <br />sufficient off-street parking and open space; and <br /> <br />Mr. Mavridis submitted the design of the triplex <br />to the Design Review Board for consideration at its <br />meeting of December 9, 1981; and <br /> <br />WHEREAS <br /> <br />the Design Review Board denied Mr. Mavridis' applica- <br />tion; and <br /> <br />WHEREAS <br /> <br />within the time specified by the Ordinance Code <br />of the City of Pleasanton, the applicant submitted <br />an appeal to the City Clerk of the City of Pleasanton; <br />and <br /> <br />WHEREAS <br /> <br />at its meeting of January 12,1982, the City Council <br />received a report dated January 5, 1982 from the <br />Director of Planning and Community Development <br />together with a copy of the Staff Report to the <br />Design Review Board regarding this matter; and <br /> <br />WHEREAS, <br /> <br />the City Council held a public hearing at which <br />time applicant and any other member of the public <br />was offered an opportunity to present evidence <br />regarding this appeal. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the appeal of Ted Mavridis of a decision <br /> of the Design Review Board and approves the design <br /> of the project subject to all 35 conditions contained <br /> in the staff report to the Design Review Board <br /> dated October 14, 1981. <br /> <br />Section <br /> <br />2: Finds that the Design Review Board in denying the <br /> application of Ted Mavridis for the proposed triplex <br /> was not in accordance with Section 2-10.04 of the <br /> Code and that the design as proposed with 35 <br /> conditions will result in a harmonious and attractive <br /> building complex. <br /> <br /> <br />
