CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 82-11 RESOLUTION APPROVING THE APPEAL OF TED ~IAVRIDIS OF A DECISION OF THE DESIGN REVIEW BOARD DENYING A PROPOSED TRIPLEX ON SPRING STREET WHEREAS , the City CoUncil recently approved an appeal of Ted Mavridis of a decision of the Board of Adjustment denying a variance to allow the construction of a triplex at 276 Spring Street which would not have sufficient off-street parking and open space; and Mr. Mavridis submitted the design of the triplex to the Design Review Board for consideration at its meeting of December 9, 1981; and WHEREAS the Design Review Board denied Mr. Mavridis' applica- tion; and WHEREAS within the time specified by the Ordinance Code of the City of Pleasanton, the applicant submitted an appeal to the City Clerk of the City of Pleasanton; and WHEREAS at its meeting of January 12,1982, the City Council received a report dated January 5, 1982 from the Director of Planning and Community Development together with a copy of the Staff Report to the Design Review Board regarding this matter; and WHEREAS, the City Council held a public hearing at which time applicant and any other member of the public was offered an opportunity to present evidence regarding this appeal. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the appeal of Ted Mavridis of a decision of the Design Review Board and approves the design of the project subject to all 35 conditions contained in the staff report to the Design Review Board dated October 14, 1981. Section 2: Finds that the Design Review Board in denying the application of Ted Mavridis for the proposed triplex was not in accordance with Section 2-10.04 of the Code and that the design as proposed with 35 conditions will result in a harmonious and attractive building complex.
