CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-39 <br /> <br />RESOLUTION APPROVING SANITARY SEWER LIFT STATION <br />~INTENANCE AGREEMENT FOR TRACT 4372, CARRIAGE <br />GARDENS, LIVERMORE ACRES, INC. <br /> <br />WHEREAS, <br /> <br />Condition No. 14 of the tentative map approval of <br />Tract 4372 mandates that the developer enter into <br />an agreement with the City requiring the developer <br />to provide a maintenance fund for the sanitary <br />sewer lift station for a minimum ten year period; <br />and <br /> <br />WHEREAS, <br /> <br />at its meeting of February 9, 1982, Council reviewed <br />the proposed agreement; and <br /> <br />WHEREAS, <br /> <br />it is in the best interests of the City of Pleasanton <br />to enter into this agreement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the Sanitary Sewer Lift Station Maintenance <br /> Agreement between the City of Pleasanton and <br /> Livermore Acres, Inc., a copy of which is attached <br /> hereto and incorporated herein by this reference. <br /> <br />Section 2: Authorizes the appropriate City officials to <br /> execute the agreement. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED FEBRUARY 9, 1982 BY THE FOLLOWING <br />VOTE: <br /> <br />AYES: <br /> <br />Councilmembers - Butler, <br />Mayor Mercer <br />None <br />None <br />None <br /> <br />Kephart, Mohr, Wood and <br /> <br /> ABSENT: <br /> ABSTAIN: <br /> <br /> ATTEST: <br /> ET <br />~~alker, ~t~y Clerk APPROVED AS TO FORM: <br />By Doris George, Deputy City Clerk <br /> <br /> Brian W.
